Your friend replied with the \u201cDistracted Boyfriend\u201d meme. Someone else dropped a \u201cRasode Mein Kaun Tha\u201d remix song made by Yashraj Mukhate. And then another friend of yours who is a big fan of Hera Pheri sent Akshay Kumar\u2019s smile GIF. Nobody asked for any consent or permission or paid a rupee to use these templates. So here\u2019s the question nobody in that chat is googling or searching: Is posting memes copyright infringement in India?<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Short answer? Technically, it often can be. Practical answer? It depends on what you post, where you post it and why. Let\u2019s break all this down and simplify.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>1. Legally, they don\u2019t. Under the <a href=\"https:\/\/indiacode.gov.in\/act\/6b893162-631a-453b-a7b9-89685716889b\/sections\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Copyright Act, 1957 (\u2018the 1957 Act\u2019)<\/a>, copyright exists in original literary, dramatic, musical and artistic works, films and sound recordings. Nothing in that list says the fact that <em>\u201cunless it\u2019s funny\u201d<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Break a typical meme into its raw ingredients and you will find at least two owners hiding in it:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Ingredient<\/strong><\/td><td><strong>Likely Owner<\/strong><\/td><\/tr><tr><td>Movie or web series still<\/td><td>Film Producer<\/td><\/tr><tr><td>Stock photo (Distracted Boyfriend, for instance)<\/td><td>Photographer or stock agency<\/td><\/tr><tr><td>Audio in a Reel<\/td><td>Label owns the sound recording and composer\/lyricist owns the underlying work<\/td><\/tr><tr><td>Cartoon or illustration<\/td><td>Audio or studio<\/td><\/tr><tr><td>Screenshot of someone\u2019s tweet\/x post<\/td><td>Author of the tweet, if it clears the originality bar<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Here\u2019s the part people miss. A film\u2019s copyright owner has the exclusive right to make a photograph of any image from the film.<sup data-fn=\"a2ad1990-4d98-49ec-81a8-d2701e3f8ffa\" class=\"fn\"><a id=\"a2ad1990-4d98-49ec-81a8-d2701e3f8ffa-link\" href=\"#a2ad1990-4d98-49ec-81a8-d2701e3f8ffa\">1<\/a><\/sup> So screenshotting that iconic Hera Pheri scene is on paper making a copy since you did not record the film, did not upload it or took one frame. That shall still infer as reproduction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now layer on what shall happen next. Adding your own caption on top may count as an adaptation and sharing it on Instagram is communication to the public. That is three exclusive rights in one post that took you thirty seconds to make.<sup data-fn=\"90d56286-d361-493e-bb64-2083177db531\" class=\"fn\"><a id=\"90d56286-d361-493e-bb64-2083177db531-link\" href=\"#90d56286-d361-493e-bb64-2083177db531\">2<\/a><\/sup> Doing any of this without a permission is infringement under Section 51.<sup data-fn=\"52ed5d11-f6cb-4cb2-b34e-2f887ab3a88e\" class=\"fn\"><a id=\"52ed5d11-f6cb-4cb2-b34e-2f887ab3a88e-link\" href=\"#52ed5d11-f6cb-4cb2-b34e-2f887ab3a88e\">3<\/a><\/sup><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>2. Panic Later. Meet \u2018Fair Dealing\u2019<\/strong>.<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Before you delete your camera roll, meet Section 52 of the 1957 Act, which lists acts that are not infringement. Three of them matter for memes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Private or personal use, including research<\/li>\n\n\n\n<li>Criticism or review<\/li>\n\n\n\n<li>Reporting of current events and current affairs<sup data-fn=\"125e4852-38c2-4055-82e2-4cc4a23df9fb\" class=\"fn\"><a id=\"125e4852-38c2-4055-82e2-4cc4a23df9fb-link\" href=\"#125e4852-38c2-4055-82e2-4cc4a23df9fb\">4<\/a><\/sup><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Now the distinction that trips up almost every Indian law student who learnt copyright from American YouTube videos. Indian law differs from US law here. The US has open-ended \u201cfair use\u201d. It is a four-factor test where a judge weighs purpose, nature, amount and market effect.<sup data-fn=\"0b0247a7-c3d0-4ec1-a53b-3b6ae2fd9a83\" class=\"fn\"><a id=\"0b0247a7-c3d0-4ec1-a53b-3b6ae2fd9a83-link\" href=\"#0b0247a7-c3d0-4ec1-a53b-3b6ae2fd9a83\">5<\/a><\/sup> Any purpose can qualify if the factors line up.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whereas, India has \u201cfair dealing\u201d, which is a closed list. If your use does not fall within a listed purpose, you do not get to argue it was fair anyway. \u201cBut, I wasn\u2019t making money\u201d is not a valid defense since the argument is about damages not liability. With those listed purposes, Indian courts weigh how much of the copyrighted content you took, why you took it and whether you have damaged the owner\u2019s market. The Delhi High Court\u2019s approach in the Rameshwari Photocopy (DU photocopy)<sup data-fn=\"99512c04-430e-4dbe-b0e5-fe20a29ae278\" class=\"fn\"><a id=\"99512c04-430e-4dbe-b0e5-fe20a29ae278-link\" href=\"#99512c04-430e-4dbe-b0e5-fe20a29ae278\">6<\/a><\/sup> case is a useful anchor. The Court read the exception purposely rather than grudgingly by refusing to treat every act of copying as presumptively wrong.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>So, is parody protected?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is no standalone parody exception in the 1957 Act. However, courts have been willing to parody as a form of criticism.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Civic Chandran v. Ammini Amma<\/em><sup data-fn=\"56bc0ad4-4ce4-47e9-a138-c874728df288\" class=\"fn\"><a id=\"56bc0ad4-4ce4-47e9-a138-c874728df288-link\" href=\"#56bc0ad4-4ce4-47e9-a138-c874728df288\">7<\/a><\/sup>, the Kerala High Court examined a counter drama that lifted characters, situations and dialogue from a well-known Malayalam play in order to attack its politics. The court refused an injunction, reasoning that the purpose was criticism and that the counter-drama was not competing with or substituting for the original.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The takeaway for memes is sharper than it looks. A meme that comments on the source or uses the source to comment on something else has a real argument. A meme that simply reposts a funny clip because \u201cit\u2019s funny\u201d is just reproduction with a caption on it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So, just ask yourself: If a judge asked \u201cwhat is this post criticising?\u201d, would you have an answer?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>3. The Real Risk Meter: Personal Post v. Brand Post<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Let\u2019s be honest. No producer shall be suing a 19 year old over a WhatsApp sticker. Enforcement follows money and the exposure climbs steeply the moment a meme starts earning. Here\u2019s a risk analysis and bifurcation:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Scenario<\/strong><\/td><td><strong>Risk<\/strong><\/td><td><strong>Why<\/strong><\/td><\/tr><tr><td>Meme in a private group chat<\/td><td>Low<\/td><td>Personal use, no market harm<\/td><\/tr><tr><td>Personal Instagram meme about a news event<\/td><td>Low to moderate<\/td><td>Plausible criticism or current-events argument<\/td><\/tr><tr><td>Meme page running ads and brand collaborations<\/td><td>Moderate<\/td><td>You are monetising someone else\u2019s work<\/td><\/tr><tr><td>Brand using a film still for moment marketing<\/td><td>High<\/td><td>Commercial, no listed purpose or lack of consent and implied endorsement<\/td><\/tr><tr><td>T-shirts, mugs or stickers with meme characters<\/td><td>Very High<\/td><td>Straight commercial exploitation and merchandising rights<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Globally, cautionary tales come from brands. In the US, the owners of Grumpy Cat brand won around USD 710,000 against a US beverage company that used the cat\u2019s image beyond its licence.<sup data-fn=\"1a306e12-5b38-4d73-a721-bb788f88b851\" class=\"fn\"><a id=\"1a306e12-5b38-4d73-a721-bb788f88b851-link\" href=\"#1a306e12-5b38-4d73-a721-bb788f88b851\">8<\/a><\/sup> The lesson to learn here is that virality does not convert a protected work into free meme stock. If you are advising a social media team, that table is the whole conversation.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>4. Plot Twist: Copyright is only half the problem<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Personality rights<\/strong>: Most Indian memes feature real and famous faces. In <em>Anil Kapoor v. Simply Life India<\/em>, the Delhi High Court restrained others from misusing the actor\u2019s name, image, voice and catchphrase \u201cjhakaas\u201d, including GIFs, morphed images and deepfakes for commercial purposes.<sup data-fn=\"0b3a1e14-65d9-4425-a793-6c7faaf611e1\" class=\"fn\"><a id=\"0b3a1e14-65d9-4425-a793-6c7faaf611e1-link\" href=\"#0b3a1e14-65d9-4425-a793-6c7faaf611e1\">9<\/a><\/sup> The Bombay High Court protected singer Arijit Singh against AI voice cloning.<sup data-fn=\"8dfbeb6a-5d9b-40d0-b188-6274fe3dec7a\" class=\"fn\"><a id=\"8dfbeb6a-5d9b-40d0-b188-6274fe3dec7a-link\" href=\"#8dfbeb6a-5d9b-40d0-b188-6274fe3dec7a\">10<\/a><\/sup> Satire and news generally remain safe, but using a star\u2019s face to sell your product does not.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Trademarks<\/strong>: Putting a brand logo in a meme for laughs is usually fine, since trademark infringement needs use of the trademark in the course of trade<sup data-fn=\"cf7a7fe7-c50e-4cab-9b18-1a17bb80ca14\" class=\"fn\"><a id=\"cf7a7fe7-c50e-4cab-9b18-1a17bb80ca14-link\" href=\"#cf7a7fe7-c50e-4cab-9b18-1a17bb80ca14\">11<\/a><\/sup>. If your brand\u2019s meme suggests a tie-up with another brand or disparages it, though, you are in risky territory.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Takedowns<\/strong>: Rights holders rarely sue meme accounts. They file takedown notices via the social media platform where such content is posted. Platforms usually comply so they keep their safe harbour protection.<sup data-fn=\"615903c9-3053-47d3-8152-0a5ebf351308\" class=\"fn\"><a id=\"615903c9-3053-47d3-8152-0a5ebf351308-link\" href=\"#615903c9-3053-47d3-8152-0a5ebf351308\">12<\/a><\/sup> Repeated strikes can cost you a meme page and disable an account on repeated strikes as well.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>5. Your Meme Hygiene Checklist<\/strong><\/h3>\n\n\n\n<figure class=\"wp-block-image aligncenter size-large is-resized\"><img decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/www.lawctopuslawschool.com\/blog\/wp-content\/uploads\/2026\/09\/image-23-1024x683.png\" alt=\"\" class=\"wp-image-1694\" style=\"aspect-ratio:1.6177884615384615;width:673px;height:auto\" srcset=\"https:\/\/www.lawctopuslawschool.com\/blog\/wp-content\/uploads\/2026\/09\/image-23-1024x683.png 1024w, https:\/\/www.lawctopuslawschool.com\/blog\/wp-content\/uploads\/2026\/09\/image-23-300x200.png 300w, https:\/\/www.lawctopuslawschool.com\/blog\/wp-content\/uploads\/2026\/09\/image-23-768x512.png 768w, https:\/\/www.lawctopuslawschool.com\/blog\/wp-content\/uploads\/2026\/09\/image-23.png 1536w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><em>Image generated by OpenAI<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Run this before you post or before you sign off on a client\u2019s post:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Is it commercial? If a brand, sponsor or product is anywhere near it, use licensed or original templates.<\/li>\n\n\n\n<li>Am I adding something? Commentary, critique or parody beats plain reposting.<\/li>\n\n\n\n<li>How much did I take? One still is defensible. A forty-second clip is not.<\/li>\n\n\n\n<li>Is a real person\u2019s face doing the selling? That is personality rights, separate from copyrights.<\/li>\n\n\n\n<li>Could a viewer infer a brand tie-up? If yes, redo it.<\/li>\n\n\n\n<li>Have I credited the source? Credit doesn\u2019t cure infringement, but it shows good faith and respects the author\u2019s moral rights under Section 57.<sup data-fn=\"b96e3ecb-4afb-4d56-a0c6-4d0ca1b7a589\" class=\"fn\"><a id=\"b96e3ecb-4afb-4d56-a0c6-4d0ca1b7a589-link\" href=\"#b96e3ecb-4afb-4d56-a0c6-4d0ca1b7a589\">13<\/a><\/sup><\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>The Takeaway<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Posting memes is not automatically illegal, but it is not automatically free either. Personal and commentary driven are usually safe. Commercial memes built on someone else\u2019s film, photograph or face are where notices, strikes and suits live.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you want to advise creators and brands on this, you need to know how fair dealing is argued, how licences are drafted and how personality rights claims are built.
