Cedric Diggory has just been selected as Hogwarts&#8217; champion, and the Hufflepuff table erupts in cheers, their excitement resonating loudly enough to overshadow everything else. Fleur Delacour and Viktor Krum have been chosen to represent Beauxbatons and Durmstrang, respectively. The thrill of the selection process is over- until the Goblet of Fire erupts in a sudden and volatile burst of crimson flames. The entire Hall descends into silence. Even Dumbledore looks uneasy. A fourth piece of parchment, its edges still smouldering, floats out from the flames and settles into his palm.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>In a quiet voice, as though he doesn&#8217;t quite believe it, he reads the name once: &#8220;Harry Potter.&#8221;<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Silence envelops the room, not a single person claps. Harry remains still- his initial thought is not one of fear, but of utter dread, for he is very much aware of what everyone is about to assume: that he has once more inserted his own name for the sake of attention. He is fourteen years old. He never asked to be in this place. Miss either one and the law doesn&#8217;t care how magical, or unavoidable the event seemed &#8211; there is no contract at all.<sup data-fn=\"0fac3f4a-0feb-4f67-a6c7-75d6b9794ab0\" class=\"fn\"><a id=\"0fac3f4a-0feb-4f67-a6c7-75d6b9794ab0-link\" href=\"#0fac3f4a-0feb-4f67-a6c7-75d6b9794ab0\">1<\/a><\/sup><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 11 gives the definition of competence. It states that you must have attained the age of majority, be of sound mind and not be disqualified by any legislation to which you are subject to.<sup data-fn=\"0f333b4b-06a4-439b-9ca0-b01b315d7a88\" class=\"fn\"><a id=\"0f333b4b-06a4-439b-9ca0-b01b315d7a88-link\" href=\"#0f333b4b-06a4-439b-9ca0-b01b315d7a88\">2<\/a><\/sup> Consent, according to Section 13 of the Act, is that the parties agree on the same thing, and Section 14 of the Act adds the key part: the agreement only counts as free consent if it was not forced, tricked, or created by fraud.<sup data-fn=\"85edc84e-e231-4a17-979a-9e14ae2841da\" class=\"fn\"><a id=\"85edc84e-e231-4a17-979a-9e14ae2841da-link\" href=\"#85edc84e-e231-4a17-979a-9e14ae2841da\">3<\/a><\/sup><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What Would Breaking It Have Actually Cost Him?&nbsp;<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The books never really tell us. It is never clarified what the consequences might have been had Harry chosen to simply decline competing in the tournament. However, the wizarding world deals with binding contracts regularly, and the books themselves provide us with precedents which we can refer to.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Take the Unbreakable Vow, a binding contract in almost the fullest legal sense. When Harry asks Ron what happens if you break one, Ron responds without a moment&#8217;s pause: \u201cYou die\u201d.<sup data-fn=\"be4a6b8d-6c52-49d7-a889-1f722b6ded89\" class=\"fn\"><a id=\"be4a6b8d-6c52-49d7-a889-1f722b6ded89-link\" href=\"#be4a6b8d-6c52-49d7-a889-1f722b6ded89\">4<\/a><\/sup>\u00a0 No loopholes, no warnings- the instant the contract is breached, the magic enforces the penalty, immediate and irrevocable. Or let&#8217;s take Hermione&#8217;s parchment for Dumbledore&#8217;s Army, a document that each member signed, without reading the fine print. She never revealed to anyone that she had jinxed it, yet the moment Marietta Edgecombe violated that agreement by betraying the group, the word &#8220;SNEAK&#8221; erupted in boils across her face- a penalty clause woven directly into the contract, activating the instant someone violated it.<sup data-fn=\"0c71aa93-b033-4ac8-8b5e-f6ec11682597\" class=\"fn\"><a id=\"0c71aa93-b033-4ac8-8b5e-f6ec11682597-link\" href=\"#0c71aa93-b033-4ac8-8b5e-f6ec11682597\">5<\/a><\/sup><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Considering these precedents, had Harry chosen to withdraw from the tournament, one might anticipate a comparable consequence- perhaps a jinx, a mark, or even a curse linked to the Cup itself. What that consequence would have looked like, the books never explicitly mention.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Except There Was Never a Valid Contract to Break&nbsp;<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Now the twist is that none of that speculation matters, as Harry was never eligible to enter into that contract in the first place. According to wizarding law, the age of majority is 17. Just before the Goblet is lit, Dumbledore himself states that only pupils &#8220;of age- that is to say, seventeen years or older&#8221; would be permitted to submit their names in the Goblet.<sup data-fn=\"6c035b97-0c52-489c-8043-00ff5f56dc57\" class=\"fn\"><a id=\"6c035b97-0c52-489c-8043-00ff5f56dc57-link\" href=\"#6c035b97-0c52-489c-8043-00ff5f56dc57\">6<\/a><\/sup> Harry was just fourteen years old. He was not eligible to be bound by anything according to the tournament&#8217;s own declared regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indian law also draws the boundary at the same location. According to Section 11 of the Act, a person cannot enter into a contract until they have reached the age of majority.<sup data-fn=\"4f4caef1-b75f-49d4-aa91-ccc7d2d6a04c\" class=\"fn\"><a id=\"4f4caef1-b75f-49d4-aa91-ccc7d2d6a04c-link\" href=\"#4f4caef1-b75f-49d4-aa91-ccc7d2d6a04c\">7<\/a><\/sup> Furthermore, the Privy Council went one step further in the landmark <em>Mohori Bibee v. Dharmodas Ghose<\/em> case, stating that an agreement entered into by a minor is not just unfair or one-sided, but it is <em>void ab initio<\/em>, meaning it is regarded as if it never happened at all from day one.<sup data-fn=\"e4a27404-1941-410e-9a58-739e16a0d122\" class=\"fn\"><a id=\"e4a27404-1941-410e-9a58-739e16a0d122-link\" href=\"#e4a27404-1941-410e-9a58-739e16a0d122\">8<\/a><\/sup><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, both wizarding law and Indian law would have agreed on one point-a fourteen-year-old cannot be bound by this type of a contract- even if Harry had personally marched up and cast his name into the flames.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Second Ground: Consent&nbsp;<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This contract fails in a second, independent way. As per Section 14 of the Act, free consent is needed to enter into a valid contract and any agreements induced through coercion or fraud are void. Harry did not even enter his name personally. It was slipped into the Goblet by Barty Crouch Jr., disguised as Professor Moody, under a powerful Confundus Charm designed specifically to trick the Goblet into accepting a fourth school and a fourth champion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Harry didn&#8217;t cast his name, didn&#8217;t give his consent, and didn&#8217;t even realise his name was being considered until it was announced. He didn&#8217;t sign anything, accept an offer, or do anything at all. Dumbledore telling Harry he &#8220;has no choice&#8221; but to compete wasn&#8217;t a statement of contract law- it was raw magical compulsion dressed up as an obligation.
