Thirty seconds of content, a trending audio track, a few transitions, and it is done. Except, creators know that it rarely works that way.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is the idea you spent time developing, the script you rewrote three times, the footage you shot and reshot, the graphics you designed, and the final edit that somehow took much longer than expected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then you open Instagram one day and see something that looks <em>very<\/em> familiar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Maybe someone has reposted your Reel. Maybe they have used your script almost word for word. Or perhaps they have simply created their own Reel on the same idea.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your first thought is probably, <strong>\u201cCan they even do this?\u201d<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That brings us to an increasingly important question for Indian creators: <strong>Can an Instagram Reel be protected by copyright?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The short answer is yes, in many cases. But there is more to it than simply saying, <em>\u201cI made the Reel, so I own everything in it.\u201d<\/em> A single Reel can bring together several creative elements, and copyright may treat each of them differently.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So, before you type <em>\u201ccopyright infringement\u201d<\/em> in the comments or send an angry DM, it helps to understand what the law actually protects and what it does not.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Can an Instagram Reel Have Copyright?<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\">The short answer is Yes!<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Copyright Act, 1957 does not specifically mention &#8220;Instagram Reels&#8221;.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, <strong>section 13<\/strong> protects categories such as original literary, dramatic, musical and artistic works, cinematograph films and sound recordings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A single Reel can contain several of these.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, your Reel may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>original video footage;<\/li>\n\n\n\n<li>a script;<\/li>\n\n\n\n<li>photographs or illustrations;<\/li>\n\n\n\n<li>graphics and animations;<\/li>\n\n\n\n<li>voice-over; and<\/li>\n\n\n\n<li>original music or sound.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">So, copyright may exist in different elements that together make up your Reel.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>But what about the idea which took hours to materialise?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose you post a Reel titled <strong>\u201c5 Things Nobody Tells You About Your First Law Firm Internship.\u201d<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It does well. People share it, save it, tag their friends.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then, a week later, you are scrolling through Instagram and stop at a familiar-looking title.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Another creator has made a Reel on <strong>the exact same topic<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your first thought might be: <em>Wait, didn\u2019t I do this first?<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Maybe you did. But that alone does not make it copyright infringement.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full is-resized\"><img decoding=\"async\" src=\"https:\/\/www.lawctopus.com\/wp-content\/uploads\/2026\/08\/Copyrighting-an-Instagram-Reel.jpg\" alt=\"\" style=\"width:404px;height:auto\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">If they have thought of their own five points, written their own script, stood in front of their own camera and shared their own take, they have essentially taken the <strong>idea<\/strong> and created something of their own from it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Copyright generally does not let us put a lock on an idea. But imagine something slightly different.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You open their reel and hear your sentences. Not just the same message, but almost the same words, in the same sequence. Or perhaps they have skipped the effort altogether, downloaded your video and uploaded it to their own account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now we are in very different territory. Because there is a difference between <strong>\u201cI like this idea; let me make my own version\u201d<\/strong> and <strong>\u201cI like this content; let me use it as my own.\u201d<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your topic may inspire someone else. Your internship experiences may even spark ten more Reels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But your <strong>script, footage, graphics, photographs and other original creative elements<\/strong> are another matter. Those are part of how you chose to express the idea, and copyright can protect that expression.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A simple way to remember it?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Same idea, different creation? Usually not the problem.<\/strong><strong><br><\/strong><strong>Same creation, copied or repackaged? That is where copyright questions begin.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Do You Need to Register Copyright for Every Reel?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">No. Copyright protection in India is generally <strong>automatic<\/strong>. You do not have to register every Reel before it can receive copyright protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Registration can, however, be useful as evidence in an ownership dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For creators producing content every day, registering every post may not be practical. But registration may be worth considering for particularly valuable content or works forming an important part of a creator&#8217;s business.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And whether or not you register, keep your <strong>evidence for everything and all your files.<\/strong> They can help establish how and when your content was created.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Now what about Trending Music we used in the Reel?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where things get interesting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You open Instagram and hear the same song on hundreds of Reels. It is easy to assume:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Everyone is using it, so why can&#8217;t I use it on my reel?&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Just because a song is available on Instagram does not mean you own it or can use it anywhere you want.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When Instagram makes music available through its music library, you may be allowed to use that music <strong>within the platform, subject to Instagram&#8217;s licensing terms and restrictions<\/strong>. But the copyright in the song and sound recording still belongs to their respective rights holders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction matters if you download the same Reel and use it elsewhere, particularly for commercial purposes. Your permission to use music on Instagram does not automatically travel with your Reel to every other platform or use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In short: Instagram may give you a licence to use a song. It does not give you ownership of the song.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same rule applies to photographs, video clips, illustrations and other third-party content you include in your Reel.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Does &#8220;Credits to the Owner&#8221; Make Copying Legal?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You have probably seen captions such as:<\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><strong>&#8220;No copyright intended.&#8221;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><strong>&#8220;Credits to the original creator.&#8221;<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><strong>&#8220;DM for credit\/removal.&#8221;<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full is-resized\"><img decoding=\"async\" src=\"https:\/\/www.lawctopus.com\/wp-content\/uploads\/2026\/08\/image-34.png\" alt=\"\" style=\"width:456px;height:auto\"\/><\/figure>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"><em>Image source: <a href=\"https:\/\/www.instagram.com\/reel\/DVkmZhBjp9O\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">https:\/\/www.instagram.com\/reel\/DVkmZhBjp9O\/<\/a><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">None of these phrases automatically gives someone permission to use copyrighted content.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Giving credit and obtaining permission are two different things.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If permission is legally required, tagging the creator after using their work does not automatically solve the problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So, <strong>&#8220;Credits: @originalcreator&#8221; is not a magic copyright disclaimer.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What About Reaction and Remix Reels?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose someone uses a portion of your Reel and then criticises or reviews what you said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Is that automatically copyright infringement? No.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 52 of the Copyright Act recognises certain situations where use of copyrighted works does not amount to infringement. These include fair dealing for purposes such as criticism or review and reporting current events, subject to the requirements of the law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But that does not mean every video labelled &#8220;reaction&#8221; or &#8220;educational&#8221; is automatically protected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is also no universal rule that says:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8220;Use less than 10 seconds and you&#8217;re safe.&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The circumstances and purpose of the use matter.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What If a Brand Paid You to Create the Reel?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is one area creators should take seriously. Suppose a brand pays you \u20b930,000 to make three Reels. You shoot and edit everything yourself. But who can use those videos afterward?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Can the brand run them as advertisements?&nbsp;<\/li>\n\n\n\n<li>Can it upload them on other platforms?&nbsp;<\/li>\n\n\n\n<li>Can it edit them?&nbsp;<\/li>\n\n\n\n<li>Can you reuse them?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The answer can depend on the arrangement and, importantly, <strong>your contract<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before signing a creator or influencer agreement, check clauses dealing with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>intellectual property and ownership;<\/li>\n\n\n\n<li>assignment or licensing;<\/li>\n\n\n\n<li>duration and territory;<\/li>\n\n\n\n<li>exclusivity; and<\/li>\n\n\n\n<li>reuse and modification of content.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Do not focus only on the amount you are being paid. Check what rights you are giving away in return.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same applies when you hire photographers, editors or videographers. A simple written agreement about ownership can prevent a much bigger dispute later.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Someone Stole Your Reel. What Should You Do?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Your first instinct may be to leave an angry comment. Before doing that, <strong>preserve the evidence<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Take screenshots or screen recordings showing the copied Reel, username, caption and other relevant details. Save the link and note when you discovered it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then gather evidence of your own creation:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>raw footage;<\/li>\n\n\n\n<li>original script;<\/li>\n\n\n\n<li>editing files;<\/li>\n\n\n\n<li>drafts;<\/li>\n\n\n\n<li>original photographs; and<\/li>\n\n\n\n<li>dated communications relating to the content.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the circumstances, you may use Instagram&#8217;s copyright reporting mechanism. Serious commercial copying or repeated infringement may justify obtaining legal advice and considering remedies available under the Copyright Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Do this before you hit \u2018Post\u2019!<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Most creators think about copyright only after someone copies their work. A better habit is to leave a simple trail showing that the content started with you.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Keep the first draft of your script. Save the unedited footage instead of deleting it once the Reel is live. Hold on to your editing files, original graphics and important emails with freelancers or brands.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You do not need to create a legal file for every Reel you post. Your normal creative process already leaves behind useful evidence of when and how the work was made.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And if you regularly work with editors, photographers or brands, sort out ownership <strong>before<\/strong> the content goes live. A two-minute conversation today can prevent a much longer argument over who owns the Reel later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Creator tip:<\/strong> Your final Reel shows what you created. Your drafts and raw files can help show that <em>you created it.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is much better at this stage because it introduces the idea of a <strong>\u201ccopyright trail\u201d<\/strong>, which we haven&#8217;t properly explored earlier, and gives the reader one practical habit to take away.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Your Reel May Be Short. Your Rights Are Not.<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A Reel may disappear from someone&#8217;s feed in seconds, but creating it can involve hours of work. The good news is that Indian Copyright Law does not leave digital creators outside its protection simply because their work appears on Instagram. At the same time, creators should understand the other side of copyright too.
